In those instances, at least the ones I've seen, its been static generated while the person is entering and exiting the vehicle which charges up their body and then when they touch the metal pump handle to extract it from the tank they get a spark. In these cases the spark was right at the filler neck.

I'm thinking I saw a mythbusters about that one once..... not that they are the ultimate authority.....
