So you think sitting at a red light in your coach pulling a toad without a brake system and someone runs into you would make you at fault because you didn't have a brake system for the toad?
Yeah, let's throw logic and common sense out the window and bow down to paranoia.
You're only at fault if the lack of a braking system contributed to the accident, including your failure to avoid the accident due to your increased braking distance.
